Cancellation(/Revocation) Policy

1. Right to Cancel(/Revoke)

 Client’s orders are deemed irrevocable. Cancellation or amendment of an order is only possible with Jama-Trading’s written consent and to the extent this can reasonable be expected from Jama-Trading and provided client pays cancellation costs in the amount of 15% of the invoice (excluding VAT). If client’s request for amendment or additions imposes additional costs on Jama-Trading, Jama-Trading is entitled to charge these costs in full to client. In that case, Jama-Trading is also entitled to set a new delivery date. Cancellation of an order specifically made, adjusted, designed or loaded for client (e.g. stacking) or of specific services rendered at client’s request is not possible.

2. Address

To exercise the right to cancel, you must inform us [(Jama-Trading Group, Antoon van Wijngaardenweg 22, 4105 SH Culemborg, +31(0)6 46717824)] of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or email). 


3. NON-FULFILMENT/CANCELLATION/SUSPENSION


  1. Jama-Trading shall be authorized to rescind the agreement in full or in part or to suspend its performance under the agreement, with immediate effect, without judicial intervention, and without prejudice to Jama-Trading’s other rights and remedies (to fulfilment and/or damages), if:
    1. -     client acts in contravention of any provision of the agreement (including these AVW Jama-Trading) between parties;
    2. -     client applies for suspension of payment or makes an application for adjudication of bankruptcy;
    3. -     bankruptcy of client has been applied for or client is declared bankrupt/insolvent;
    4. -     the business of client is shut down or liquidated;
    5. -     a private composition is offered to client’s creditors. In these cases, all claims of Jama-Trading against client shall become immediately due and payable, without Jama-Trading being liable to compensate for damages or to provide a guarantee.
  2. The provision of paragraph 1 of this article shall also apply if client, after being requested in writing to do so, has failed to provide in Jama-Trading’s opinion satisfactory security within seven days. All costs in this respect are for client’s account.
  3. If client fails to make payment in time or fails to take delivery during a period of more than 40 days, Jama-Trading is entitled, without being obliged to issue any further notice, to resell the goods, in which case client forfeits any down payment made to Jama-Trading as compensation for losses incurred by Jama-Trading, unless client proves that the losses incurred by Jama-Trading are less than the down payment.
